Observado que os alimentos pagos pelo de cujus <\/em>\u00e0 recorrida, ex-companheira, decorrem de acordo celebrado no momento do encerramento da uni\u00e3o est\u00e1vel, a referida obriga\u00e7\u00e3o, de natureza personal\u00edssima, extingue-se com o \u00f3bito do alimentante, cabendo ao esp\u00f3lio recolher, t\u00e3o somente, eventuais d\u00e9bitos n\u00e3o quitados pelo devedor quando em vida. Fica ressalvada a irrepetibilidade das import\u00e2ncias percebidas pela alimentada. Por maioria.

\nAC\u00d3RD\u00c3O<\/strong>
\nProsseguindo o julgamento, ap\u00f3s o voto-vista do Sr. Ministro Raul Ara\u00fajo acompanhando a diverg\u00eancia, a Se\u00e7\u00e3o, por maioria, deu provimento ao recurso especial, para reconhecer que a obriga\u00e7\u00e3o de alimentos extingue-se com o \u00f3bito do alimentante, sendo \u00f4nus do esp\u00f3lio pagar apenas eventual d\u00e9bito alimentar n\u00e3o quitado pelo de cujus, ressalvando-se a irrepetibilidade dos valores j\u00e1 percebidos pela recorrida, nos termos do voto da Sra. Ministra Nancy Andrighi, que iniciou a diverg\u00eancia.
\nLavrar\u00e1 o ac\u00f3rd\u00e3o o Sr. Ministro Antonio Carlos Ferreira. Votaram com a Sra. Ministra Nancy Andrighi (voto-vencedor), em sess\u00e3o anterior, os Srs.
